RE: The tariff classification of gloves from China.

Dear Ms. Davis:

In your letter dated February 23, 2000, you requested a classification ruling on behalf of Smart Welding Products Inc. The provided samples will be returned as per your request.

Five samples were submitted for review. Style 3330 is a lined gunn cut work glove with a palmside from fingertips to wrist and a complete thumb constructed of cowhide leather. The backside of the glove and vented open cuff are made of a woven material. On the backside, leather overlays reinforce the complete forefinger, the three remaining fingertips, and the knuckle area. The glove also features a partially elasticized wrist.

Style 3340 is an unlined pigskin version of style 3330.

Style 1210 is a glove constructed a knitted cotton fabric featuring fourchettes, a hemmed bottom, and a vented wrist with a plastic snap closure.

Style 1270 is a 80% polyester 20% cotton string-knit work glove with a PVC dot coating covering the complete palmside from fingertips to wrist. The coating weighs less then 50% of the string-knit glove. The glove features an overlock stitched cuff.

Style 1430 is a gunn cut work glove with two-ply construction of the palmside from fingertips to wrist, complete thumb and forefinger. The outer ply is a 80% polyester 20% cotton woven fabric. Additionally, the glove features a ribbed knit cuff. The essential character of the glove is imparted by the palmside woven fabric. The applicable subheading for styles 3330 will be 4203.29.1800, Harmonized Tariff Schedule of the United States (HTS), which provides for Articles of apparel and clothing accessories, of leather or of composition leather: gloves, mittens and mitts: other: gloves of horsehide or cowhide (except calfskin) leather: other: other. The duty rate will be 14 percent ad valorem.

The applicable subheading for style 3340 will be 4203.29.3020, HTS, which provides for Articles of apparel and clothing accessories, of leather or of composition leather: gloves, mittens and mitts: other: other: other: men’s . . . lined. The rate of duty will be 14 percent ad valorem.

The applicable subheading for style 1210 will be 6116.92.7450, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: other: of cotton: other: made from a pre-existing machine knit fabric: with fourchettes . . . jersey type, brushed or napped fabric. The duty rate will be 24.1 percent ad valorem.

The applicable subheading for style 1270 will be 6116.10.5520, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other: containing 50 percent or more by weight of cotton, man-made fibers or other textile fibers, or any combination thereof . . . subject to man-made fiber restraints. The duty rate will be 13.5 percent ad valorem.

The applicable subheading for style 1430 will be 6216.00.5420, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mitten and mitts: other: of man-made fibers: other: without fourchettes . . . other. The duty rate will be 21.2 cents per kilogram plus 10.6 percent ad valorem.

Style 1210 falls within textile category designation 331, and styles 1270 and 1430 fall within textile category designation 631. Based upon international textile trade agreements products of China within these categories are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
